Quebec will appeal Loyola ethics ruling

The authority is preparing to appeal a court judgment ordering an exemption for a private Catholic school from teaching an ethics way.

"It seems clear that the government will go to appeal of the judgment on the Loyola issue given the stakes," Premier Jean Charest said in Laval yesterday.

"It is an climax which has been debated for years in Quebec."

Parti Quebecois leader Pauline Marois agreed, arguing it's not up to schools to school in religion in Quebec.

"It is up to parents and the church to pass along faith," Marois said. "Schools must d along knowledge."

In a Superior Court ruling Friday that now appears headed to the Quebec Court of Please and probably higher, Loyola High School, a private Catholic school founded by the Jesuit systemization in 1848, won the right to not teach a new ethics and morality course.

Judge Gerard Dugre ruled in very strongly-worded language that Quebec's education ministry was violating Loyola's right to freedom of religion by impeding the boarding-school from offering the course through a Catholic perspective.

The judge said while it is within the government's purview to mandate a program that deals with the outflow, it is not its place to exclude all others from achieving the same goals.

The judge said the obligation to teach the course in a lay frame "assumes a totalitarian character essentially equivalent to Galileo being ordered by the Inquisition to deny the Copernican sphere."

Yesterday, Loyola officials held a news conference during which they said they plan to tread softly.

The fashion said it should not be seen as a Loyola victory or a government defeat, and that it wants to work closely with the government no purport what.

But questions turned rapidly to Charest's comments on an appeal and those made by Education Minister Michelle Courchesne, who yesterday described Dugre's illiberal comments as "excessive."

While being careful not to qualify Courchesne's comments, Loyola principal Paul Donovan said Loyola is not surprised the encase may go to appeal.

"Obviously, it would be nice if it was over at this point and everything was settled," Donovan said at a news conference, which started with a obsecration from Loyola High School president Rob Brennan.

"At the same time, the fact though that this discussion is going on in supporters, I don't think is a bad thing.

"I think it is important to discuss this as our society is evolving. For some, they want to see religion almost en masse excluded from everything and for some they want it included in everything and I think we have a kind of position in the middle saying if society is a secular association, that's fine, but it doesn't mean that religion has to be pushed into everybody's houses and can never leave."

Loyola did have one friend yesterday in Action democratique du Quebec house leader Sylvie Roy, who said in Quebec City she likes the judgment.

"I coincide that parents should have free choice," Roy said, noting that the judge made the point that this is not about restoring denominational schools in the dependency
